Annie's AI: Privacy Policy
This Privacy Policy describes the privacy policies and practices of Annies AI, LLC ("Annies AI") regarding its Apps (Annie's Anime: AI Art, Annie's Pets: AI Art, ToolTag.io), and all associated or ancillary Annies AI services or platforms provided in conjunction with the App (collectively, "App") however accessed and/or used, whether via personal computers, mobile devices, tablets, handheld devices, or through other interactive services, features, applications, and downloads.
We will refer to subscribers, customers, users, and others who download, access, use, purchase, play and/or subscribe to (collectively, "use" or "using") the App as "Users" and "User", "You" or "Your" throughout this policy.
Most of our Users will use the App as it was intended as a harmless way for friends and strangers to play together. Please take care with how you play the App, and how you manage your information and communications on the App.
Please be aware that any Personal Information that you voluntarily disclose on any public forum on the App or through any action including but not limited to messaging within our App, is publicly available and can be read, collected, or used by others, and could be used to send you unsolicited messages. Annies AI is not responsible for any third party use of User profiles, personally identifiable information, or any other identifying information that you voluntarily choose to disclose publicly using the App.
This Privacy Policy is incorporated into and is subject to the Terms of Use Agreement. Your use of the App and any Personal Information you provide in using the App is subject to the terms of this Privacy Policy and the Terms of Use Agreement.
1. Information Annies AI Collects
Users may need to provide all or some of the following in order to use the App: Facebook ID, App Center ID, Google Play Apps ID, AndroidID/IDFV, GAID/IDFA, IP Address, and/or MAC Address to Annies AI to play the App (collectively, "Personal Information"). All such Personal Information is collected by Annies AI solely to authenticate You, but all such Personal Information is stored in an encrypted fashion that cannot identify You. Your ability to use the App is not contingent on your provision of any personally identifiable information to Annies AI.
If You connect to our third party customer support ticketing platform, we may collect Your e-mail and additional Personal Information to address Your support request, which may include connecting Your Personal Information to Your App ID to resolve the support issue. Annies AI does not permanently connect this Personal Information to other information in the App. Annies AI will only store this Personal Information for so long as is necessary to address Your support request. Other than this, Annies AI does not collect any other personally identifiable information and does not connect any information about Your use of the App with any of Your Personal Information or any other personally identifiable information.
When You play our App, we collect certain types of technical information that is not Personal Information about Your mobile device, computer, tablet, or any other method used to access and operate the App ("Device"), including but not limited to device platform, type, carrier, default language, country, and time zone (collectively, "Device Information").
A User's Personal Information and Device Information will be retained for each User for as long as Annies AI’s business needs require as determined at Annies AI’s sole discretion, unless the User contacts Annies AI and requests to have his or her Personal Information and/or Device Information deleted in accordance with the procedure outlined in the section titled "How to Delete Information Obtained by Annies AI."
Annies AI may use data collected from You that does not identify you or contain any Personal Information, including any statistical information or information necessary to provide the App to you.
Playing the App may require the use of a device running Google Android or the Apple iOS.
2. Opt-In of Promotional Emails and Notifications
We do not currently send any promotional e-mail or notification. If, at some point in the future, we decide to send offers, promotions, and/or information of interest, we will obtain your prior written consent. You can always change our mind and opt out of receiving such email. To opt out of emails from us, please follow the unsubscribe instructions contained in the relevant emails or contact us at legal@AnniesAI.com. Our applications may also deliver notifications to your phone. You can disable these notifications in your phone's settings or by deleting the relevant application.
3. Information Annies AI Collects from Visits
When Users and others visit our Websites, Annies AI collects the visitor's IP address (the unique set of numbers used to identify the visitor's computer), and his or her registered domain or home server. When Users use the App, including the App itself, Websites including the Forum and Support channels, or bug tracking system, Annies AI’s servers automatically record certain information about their usage from their mobile device and/or web browser. These server logs may include information web requests, IP address, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the number of messages related to the User's profile, the amount of time spent on particular web pages, and the dates and times of requests.
If a visitor requests information by sending Annies AI an email, Annies AI may save the visitor's e-mail address and any other information that the visitor or User provides. This information will be used by Annies AI solely to provide services or products the visitor requests.
4. How to Obtain or Delete Information Obtained by Annies AI.
A User may have their Personal Information and Device Information deleted by contacting App support. This will result in the Personal Information and/or Device Information being deleted. A User may also obtain a copy of the Personal Information and Device Information collected and stored by Annies AI by contacting App support.

5. How Information Is Secured.
Annies AI uses a variety of physical, technical, and procedural safeguards to guard against loss, misuse, and alteration of Personal Information and Device Information. For example, all Personal Information transmitted from mobile devices to Annies AI is encrypted; access to Personal Information is limited to Annies AI and contractor personnel who need the information for providing the App to players; and Annies AI uses and requires its contractors to use technical measures to guard against unauthorized access to Personal Information. Annies AI cannot, however, guarantee the security of any Personal Information, Device Information, or information collected from the Websites or other correspondence including e-mail. Despite Annies AI’s efforts to secure such information, it may be accessed, disclosed, altered, or destroyed by a breach of Annies AI’s physical, technical, and procedural safeguards. Users use the App and visitors go to the Websites at their own risk. If Annies AI learns that a User's Personal Information, or Device Information has been disclosed to an unauthorized person, Annies AI will attempt to notify the User.
6. How Annies AI Uses Users' and Websites Visitors' Information.
Annies AI uses each User's Personal Information and Device Information solely as necessary to provide the App to the User. Providing the App to the User may include the following uses of Personal Information, and Device Information:
Use of Personal Information to authenticate Your App account in order to provide the App and/or Support to You.
Display of your actions, messages, and chat contributions to other Users as part of providing the App to You.
Use of aggregated Device Information and App data for analytical purposes.
You acknowledge and agree that Annies AI may share Personal Information, Device Information, and information collected from the Websites with Annies AI’s agents, corporate affiliates, or advisors who help Annies AI operate and improve its business. Annies AI has entered into or will enter into written agreements with its agents, corporate affiliates, and advisors to which it discloses Personal Information, Device Information, and information collected from the Websites that requires them to adhere to pertinent provisions of this Privacy Policy. Annies AI also prohibits its agents, corporate affiliates, and advisors from using any information disclosed to them by Annies AI for purposes other than implementing Annies AI’s instructions.
We will share some of the information we collect from You with vendors and other service providers who work with us to support the internal operations of our website and/or mobile application. For example:
We use a third party service for ad tracking and to help us prepare website and mobile application analytics. Our third party ad tracking and analytics company never sends emails, notifications, or other communications to our end users. Your choice to opt out of ad tracking and analytics services does not limit our ability to collect other information from you for other vendors, subject to the terms of this Privacy Policy.
We use a third party service to provide a forum discussion platform for App Users. Use of this forum is optional, and if a You elect to use the forum from the App, Your App ID and User Name will be used to create an account on the third party forum. No other Personal Information is transferred to the third party forum.
Annies AI may use Aggregate Data to analyze how Users use the App to determine ways in which Annies AI can improve the App and to consider offering new services to Users. Annies AI may also use information collected from the Websites to analyze traffic to the Websites to determine how to improve them.
Annies AI may use or disclose Personal Information, Device Information, and information collected through e-mail or from the Websites: to comply with applicable laws; to protect the rights and property of Annies AI or others; to protect a person's safety; to prevent abuse; as evidence in legal proceedings; to cooperate with properly authorized law enforcement investigations; and in response to subpoenas from third parties. If permitted by law, Annies AI will use good faith efforts to promptly notify a User of any subpoena that seeks any of the User's Personal Information or Device Information to enable the User to seek to quash the subpoena.
Annies AI may disclose or assign Personal Information, Device Information, and information collected from the Websites in conjunction with the sale of Annies AI to a third party or in conjunction with the sale of a portion of Annies AI’s assets.
7. Children's Information
Annies AI recognizes the importance of protecting the privacy of children. Consistent with the Children's Online Privacy Protection Act, Annies AI will not knowingly collect any Personal Information or Device Information from anyone under the age of 13. IF YOU ARE UNDER 13 YEARS OF AGE, THEN PLEASE DO NOT USE OR ACCESS THE App AT ANY TIME OR IN ANY MANNER. If Annies AI learns that Personal Information of persons less than 13-years-of-age has been collected through the App, then Annies AI will take the appropriate steps to delete this information. If you are a parent or guardian and discover that your child under the age of 18 has obtained a App account against your wishes or without your consent, then you may alert Annies AI at legal@AnniesAI.com and request that Annies AI delete that child's Device Information, Personal Information, and account from its systems.
8. How Long Do We Keep Your Information?
Following termination or deactivation of your account, Annies AI may retain your Personal Information for a commercially reasonable time solely for backup, archival, and/or audit purposes. Annies AI also implements industry standard document retention procedures and, consistent with such procedures, will delete your Personal Information when such Personal Information is no longer relevant.
9. Information Collected by Others
This Privacy Policy addresses only the policy and procedures of Annies AI. Annies AI is not responsible for the privacy policies of third parties, including but not limited to those whose websites may be linked to the Annies AI’s Websites.
10. Use Outside the United States
The App is hosted in the United States. Users who use the App from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring your personal data to the United States and by expressly consenting to our collection, storage and use of your Personal Information, your Personal Information will be transferred to the United States. 11. Enforcement
If a User believes that his or her rights as described in this Privacy Policy have been violated by Annies AI, the User should email legal@Annies AI.com or send a letter to Annies AI, 307 S Paterson St, Suite A; Madison, WI 53703. Annies AI will attempt to resolve User complaints as quickly as possible.
12. Amendments to this Privacy Policy
Annies AI reserves the right, at its sole discretion, to change, modify, add to, or remove any portion of this Privacy Policy, in whole or in part, at any time. Annies AI will include such amendments on the version of this Policy that is posted on Annies AI’s Websites. Amendments to the Policy will take effect immediately upon being posted to the Websites. It is your responsibility to check the Privacy Policy periodically for changes. User's continued use of the App after Annies AI posts an amendment constitutes User's acceptance of and consent to such amendment.

14. Bankruptcy, Merger or Acquisition
In the event that Annies AI is acquired by or merged with a third party entity, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected from our Users as part of such merger, acquisition, sale, or other change of control so that Annies AI can continue operations. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how Users' Personal Information and Device Information is treated, transferred, or used.
